GENERAL TERMS & CONDITIONS
for
‘This is Essential Work’ Exhibition funded by the Open University (OU), Open Societal Challenges Programme in partnership with the University of the West of England.
1. OU and UWE may publish the chosen artwork online under a Creative Commons CC BY-NC-ND 4.0 licence (see https://creativecommons.org/licenses/by-nc-nd/4.0/ for further information).
2. In consideration of the permission granted in section 1 above, each chosen artist will be paid £200 for exhibiting their artwork.
3. Each chosen artwork will be accompanied by an attribution identifying the artist.
4. Other than the rights set out in section 1 above, OU does not acquire any intellectual property rights, title or interest in or to the artwork. All such rights and interests remain with the artist.
5. Each artist warrants that:
4.1 All information provided by them is true and accurate;
4.2 The artwork submitted is original;
4.3 The artwork contains nothing libellous, obscene, improper, indecent or otherwise likely to bring OU into disrepute;
4.4 They are either the owner of any intellectual property and performance rights that may be contained within the artwork, or have obtained the rights holder’s permission for the inclusion of any content where they do not own such rights, and that they are authorised to submit the artwork and grant the licence set out in section 1 above. The artist will indemnify OU against all liabilities, costs, expenses, damages and losses (including reasonable legal costs) suffered or incurred by OU arising out of or in connection with any breach by the artist of these Terms & Conditions and the use of the artwork by OU.
6. ‘This Is Essential Work’ is an online open-access exhibition hosted on Squarespace platform (see https://www.squarespace.com/terms-of-service for the applicable Squarespace Terms of Service).
7. In the event of any third party claim, OU may take down the artwork from the website.
8. These Terms & Conditions and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of England and Wales.
9. The courts of England shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms & Conditions (including non-contractual disputes or claims).
By submitting to ‘This is Essential Work’ Exhibition you are deemed to accept and agree to the following:
a. The decision of the Jury on all matters is final.
b. You understand OU reserves the right to make such changes to the exhibition arrangements and these Terms & Conditions as may be deemed necessary by circumstances.
c. All personal data is processed in accordance with the applicable UK data protection legislation. The Data Controller is OU.
